On commercial property in Los Gatos, almost every tree is protected. The Town's threshold on vacant and non-residential property is 4 inches in diameter, measured 4.5 feet above grade. On a developed home lot it is 12. Any tree that a development approval, building permit or earlier tree permit required you to plant or keep is protected at any size. The parking-lot tree that looks too small to matter usually needs a permit.

The Town Arborist generally decides within 10 to 15 business days of a complete application. Large Protected trees add a neighbor notice with a 10-day comment period. An approved permit is good for 90 days, has to be posted on site while we work, and Parks and Public Works wants 48 hours of notice before work begins. Replacement trees must be planted before the permit expires. Fees, per the Town's 2025 schedule, are $256 for the first tree and $128 for each additional tree on the application.
The Town also asks applicants to check for active bird nests, especially from February 1 to August 31. Dense landscaping around buildings is where those nests turn up, so spring and summer jobs need that check built into the schedule.

The City says removal requests are frequently denied, and if it asks for an arborist report, it bills that at cost plus 20 percent. Saratoga protects any tree 10 inches in diameter and listed native species at 6 inches, measured 4.5 feet above ground.
